Nestlé’s Water Business Faces Legal Battle from Competitive Rival

Nestlé’s water division is currently entangled in a legal dispute initiated by Bonneval Emergence, a local French competitor, over accusations of “unfair competition.” This development was first reported by the French publication Le Monde, which revealed that the lawsuit was filed in Nanterre against the company infamous for its Perrier brand.

In its legal actions, Bonneval Emergence is seeking a court order to halt sales of several Nestlé bottled water brands, including Vittel, Contrex, and its flagship Perrier. They have demanded a hefty penalty of €1 million (approximately $1.2 million) for each day the company fails to comply. Additionally, Bonneval is pursuing €1.6 billion in damages, claiming that Nestlé’s operations have unjustly caused significant economic harm due to the alleged illegitimacy of its product offerings in the French market.

The core of Bonneval’s complaint hinges on the assertion that Nestlé has improperly capitalized on the designation of “natural mineral waters” for its products, thereby undermining fair competition. While the group operates under the name Bonneval Waters, it has avoided making specific public comments regarding the suit but confirmed the accuracy of Le Monde’s report to Just Drinks.

In response, representatives from Nestlé’s water division firmly stated, “Nestlé Waters takes note of this summons and believes the grounds for the lawsuit are wholly unfounded. We will vigorously defend our position.” They emphasized their commitment to the safety standards of their mineral water products, a point they assert has been continually validated by health authorities.

The conflict comes on the heels of additional scrutiny for Nestlé, with local French authorities recently blocking batches of Perrier water due to a bacteriological investigation of one of the company’s wells in Vergèze. Reports from Radio France suggested the shutdown of two mineral water sources due to contamination concerns at the Vergèze site in late November.

In various reports, Nestlé has acknowledged procedural issues related to the treatment of its bottled mineral waters under French laws. This acknowledgment has drawn further attention, causing heightened vigilance from regulators. For instance, in May, authorities mandated the removal of certain filtration systems at Nestlé’s Vergèze and Vosges production sites. Subsequently, authorities conducted a raid on Nestlé’s French headquarters as part of an inquiry stemming from a complaint initiated by consumer rights organization Foodwatch.

Earlier this month, a French judicial tribunal ruled in favor of Nestlé’s right to market its Perrier products under the “natural mineral water” label, dismissing a request from UFC Que-Choisir, a consumer advocacy group, to ban these products from the French market.

This ongoing legal saga underscores the increasing tensions within the bottled water industry, pitting local businesses against a formidable multinational entity—a battle that reflects broader issues of competition and consumer rights in the marketplace.

As Nestlé prepares to confront the court proceedings, the implications of this lawsuit will surely reverberate throughout the industry, calling into question how consumer goods companies manage their product classifications and marketing in the face of competing claims.
